General Rules
Welcome to Upper Whittemore. For your safety, please familiarize yourself with this important information. By entering Upper Whittemore, you agree to abide by the following rules and regulations.
In addition to the codes and ordinances of Utah County, the following rules apply to the UWPOA development:
- Open fires are permitted only in designated fire pits, and are prohibited entirely during fire restrictions (see Fire & Safety)
- There is no parking on any Upper Whittemore roads.
- The year-round speed limit for all Upper Whittemore roads is 15 MPH.
- There is no sledding permitted on any road that is open for travel.
- All property within the development is private, including the roads. Stay on the roads unless you are on your own lot or have the owner’s permission — everything else is someone’s private property.
- Only owners and owners’ guests may use the roads. ATVs, UTVs and motorcycles are restricted to the roads; there is no off-road use anywhere in the development.
- Short-term rentals are prohibited — property may not be rented on an overnight basis. Rentals of any length are prohibited under the CC&Rs except for a limited number of grandfathered lots (see CC&Rs III.L, Leasing Restrictions).
- This is a mountain development with steep and sometimes slippery roads. Roads are snow and ice-covered in the winter, and may have loose gravel in the summer. You acknowledge by entering through the gate that your vehicle is suitably equipped for safe operation under these conditions.
- You agree by accessing the development that you and all persons traveling in your vehicle will indemnify and hold harmless the UWPOA for any injury or property damage arising from your using the roads. UWPOA assumes no liability for the operation and use of any motorized vehicle including but not limited to ATVs, snowmobiles and other vehicles with motors.
- As a lot owner, you are responsible for reviewing these rules with your guests, and for any fines assessed against your lot as a result of their conduct.
